1. Scope

The following Terms and Conditions (T&Cs) apply to all orders of cakes placed through our online shop https://neundrei.com. These T&Cs govern the contractual relationship between you, the customer, and us, the shop operator, neundrei GmbH. By placing an order, you acknowledge and accept the T&Cs in their valid version at the time of the order.

2. Conclusion of Contract

By placing an order for cakes to be collected, you submit a binding offer to conclude a purchase agreement. The contract is formed when we send you a confirmation of the order via email.

3. Collection of Orders

All cakes ordered through the online shop must be personally collected at the designated time from cafe neundrei, Monbijouplatz 2, 10178 Berlin. The specific collection window will be defined during the order process and is binding for both parties.Orders must be picked up no later than the end of the cafe’s business hours on the designated collection day. Any uncollected orders will not be eligible for a refund.

4. Prices and Payment

The prices listed in the online shop are in Euros and include applicable VAT. Payment is made directly during the order process through the available payment methods.

5. Cancellation and Refunds by the Customer

Order cancellations are subject to the following conditions:

  • Cancellation up to 72 hours before the defined collection window: In this case, we will refund the full purchase price.
  • Cancellation between 72 and 24 hours before the defined collection window: In this case, we will retain 50% of the purchase price and refund the remaining 50%.
  • Cancellation less than 24 hours before the defined collection window: No refund will be given, and we will retain 100% of the purchase price.

6. Cancellation by the Operator

We reserve the right to cancel orders up to 48 hours before the defined collection window in cases of unforeseen circumstances such as illness, or other reasons that make it impossible to fulfill the order. In this case, we will refund the full purchase price.

7. Appearance of Cakes

Please note that while our cakes generally match the images displayed, the decoration may vary depending on the availability of seasonal ingredients such as flowers and berries. We always strive to create the most beautiful version of each cake, ensuring that it is visually delightful. Thank you for your understanding!

8. Cake Handling Instructions

To ensure your cake remains in perfect condition, please follow these guidelines during transport:

  • Always keep the cake upright to avoid damage to the decoration and layers.
  • When transporting by car, place the cake securely in the trunk or footwell rather than on the seats to avoid sudden movements.
  • If using public transportation, hold the cake as straight as possible, either in your hand or on your lap. We kindly ask that you refrain from transporting the cake by bicycle. 😉
  • Keep the cake away from direct sunlight and heat, as excessive warmth can impact its quality.
  • Upon arrival at your destination, promptly place the cake in the refrigerator. To enhance the flavor and texture, remove the cake 15-30 minutes before serving to bring it to room temperature.

By following these steps, you help preserve both the taste and appearance of your cake. Enjoy your delicious treat!

9. Gluten-Free Products Disclaimer

We offer gluten-free products; however, please be aware that our kitchen is not a completely gluten-free environment. While we take great care to minimize the risk of cross-contamination, we cannot guarantee that our products are 100% free from gluten. We advise customers with severe gluten sensitivities or celiac disease to exercise caution when consuming our products. Thank you for your understanding!

10. Liability

We are only liable for damages caused by intentional or grossly negligent breaches of duty on our part. For any other damages related to the use of our website or the collection of ordered cakes, we are liable only for the breach of essential contractual obligations.

11. Data Protection

Your order-related data will be processed in accordance with our Privacy Policy. We take the protection of your personal data seriously and use it solely for the purpose of fulfilling your order.

12. Final Provisions

If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that best reflects the economic intent of the original.
